Essential Conditions of Court Marriage as per Hindu Marriage Act 1955 section 5.
Section 5 of Hindu Marriage Act 1955 contains condition for a Hindu Marriage. Section 5 of the act lays down that " A marriage may be solemnized between any two Hindus if the following conditions are fulfilled
(1) neither party has a spouse living at the time of Marriage
(2) at the time of marriage neither party:
(a) is incapable of giving valid consent to it in consequence of unsoundness of mind or
(b) has been subject to recurrent attacks of insanity
(c) the bridegroom has completed the age of 21 and the bride age of 18 years at the time of marriage
(d) the parties are not within the degree of prohibition
So section 5 prescribe the essential requisite for a Hindu Marriage such as
1. Monogamy
2. Mental capacity of parties
3. Age of parties
4. Degree of prohibited relationship
These conditions of a Hindu marriage are supplemented by certain ceremonies as provided in section 7 of the Act.
:Eligibility Criteria & Document Requirements
Court Marriage & Arya Samaj Marriage in one day
Boy should be 21or above and Girl should be 18 or above
Documents Required for Boy & Girl for Marriage:
Age Proof, Address Proof, ID Proof and 6 Passport Size Photographs of both Bride & Groom.
Witness Required for Marriage:
Total Two Witness with their ID & Address Proof and four Passport Size Photographs each.
Affidavits Required:
Age, Marital Status (Affidavits will be prepared by us)
The whole process will be done from NCR .
The whole process takes 2-3 hours .
Boy and girl should be Hindus, Sikhs, Budhists or Jains either by birth or converted .
Choose any day from monday to friday provided no public holiday should be on that day.
Boy , girl and witnesses can be from any where india.
In case of foreign national our fee extra.
No notice or information is sent on boy's or girl's address.
Arya Samaj and Court Marriage both Certificates are issued on the same day and full proof or marriage world over and can not be challenged.
